OFFICIAL RULES

1. WHO CAN ENTER: Open only to natural persons 18 years of age or older and legal residents of the 50 United States and the District of Columbia (Entrant). Void where prohibited or restricted by law or regulation. Not eligible are employees, and their immediate families including household members, of Foster & Smith, Inc. (Sponsor), or its agents, subsidiaries, divisions, and advertising and promotion agencies.

2. HOW TO ENTER: To enter, send us a photograph in one or more of the Photo Categories described below in Section 3. You may enter online by completing our online submission form and uploading your photograph at: www.drsfostersmith.com/photocontest. You may also enter by mail by submitting your photograph with your name, address, telephone number, pet name (if applicable), submission category, and a short description of no more than 150 characters describing your photograph, and mailing to "Anniversary Photo Contest" P.O. Box 100, Rhinelander, WI 54501-0100. The contest consists of nine consecutive monthly competitions in each of ten (10) separate Photo Categories described in Section 3. The first monthly contest begins at 12:00:01 a.m. CST on April 1, 2008 and ends April 30th, 2008 11:59:59 CST. Each subsequent monthly contest begins the first day of each subsequent month at 12:00:00 CST and ends the last day of each month at 11:59:59 for the months of May to December, 2008. You may only submit one (1) photo per month for each of the ten (10) contest categories, for a total possible of ten (10) entries per month and ninety (90) for the contest. Submissions will be entered into the monthly contest active on the date the submission is received by Sponsor. All submissions will be eligible for each monthly contest in that Photo Category from the date received until the conclusion of the contest; photographs should not be submitted more than once for any Photo Category and doing so will not increase an Entrant’s chance of being selected as a Monthly Winner. Ineligible, illegible or incomplete submissions are void and will not be considered. Submitted photographs will not be returned and all submissions become the property of Sponsor. Sponsor is not responsible for lost or damaged photos or delays in delivery.

3. CONTEST PHOTO CATEGORIES AND PHOTO FORMAT RESTRICTIONS: The contest consists of nine consecutive monthly competitions for the best photograph in each of the following ten (10) separate categories (the "Photo Categories"):

	Dog		Cat		Horse		Fish
	Reptile		Wild Bird		Pet Bird		Ferret
	Small Pet (meaning any household pet not falling within any of the above categories)
	Man-made pond or other personal water feature on Entrant’s property

All photos must be in color, taken within the last year. Images may be submitted electronically, .jpeg or .tiff file format only, no larger than 3 MB. Printed photographs must be at least 4" x 6" size on photo quality paper. You may only submit your original photographs of which you are the sole owner of any copyright or other property or privacy rights; submissions of photographs taken by someone other than yourself are void. Minor digital enhancement to the photograph is permitted, but photographs or images that have been significantly modified or appear unnatural will be disqualified. Modifications expressly prohibited include: borders or frames; watermarks, signatures, or copyright notices; adding or replacing elements in an image; and artistic filters. Examples of modifications that are allowed include: cropping and rotation as necessary as long as the rectangular format is maintained; resizing so long as the aspect ratio is maintained; red-eye removal and spot editing; use of corrective functions to improve the natural appearance of the image, such as levels, contrast, brightness, curves, intensity, tone, hue, saturation, lightness, value, color balance, and tint.

4. JUDGING CRITERIA AND SELECTION OF WINNERS: Submissions will be judged on the basis of creativity, uniqueness, quality, and effectiveness in conveying the beauty and/or character of the subject. Judging will be conducted by panels of judges selected by Sponsor in Sponsor’s sole discretion for each Photo Category and for the Contest winners. All decisions by the judges will be final, including determinations of whether a photo falls within one of the Photo Categories.

Monthly Winners: First, second and third place Monthly Winners in each of the ten (10) Photo Categories will be selected by the judges for each monthly contest, for a total of ten (10) first place Monthly Winners each month, ten (10) second place Monthly Winners each month, and ten (10) third place Monthly Winners each month. Selections will be made within fifteen (15) days of the end of each contest month.

Anniversary Contest Winners: A single first, second and third place Anniversary Contest Winner will be selected by a panel of judges from the 90 first place Monthly Winners in all Photo Categories. Contest Winner selections will be made by February 15, 2009. All winners will be notified by electronic mail and/or telephone using the information provided with the entry. Notification will be attempted a minimum of five (5) times. If any winner does not respond to these notifications within three (3) days of its transmission, or if a telephone number is non-operative or email address not operational, the prize may be forfeited and awarded to an alternative winner.

5. PRIZES:
Monthly Winner Prizes: Monthly First Place: One (1) Entrant in each of the ten (10) categories will receive a first place $300.00 gift certificate redeemable by phone, mail, or online at any Drs. Foster and Smith commerce location (including LiveAquaria.com, Etropicals.com, and the Rhinelander retail store) ("Gift Certificate"). Monthly Second Place: One (1) Entrant in each of the ten (10) categories will receive a second place $200.00 Drs. Foster and Smith Gift Certificate. Monthly Third Place: One (1) Entrant in each of the ten (10) categories will receive a third place $100.00 Drs. Foster and Smith Gift Certificate.

Contest Winner Prizes: Anniversary Contest First Place: One (1) Monthly Contest Winner will be awarded first place and will receive a 6-night, 7-day trip for two persons to Maui, Hawaii, including hotel, roundtrip airfare, ground transportation to and from airport, and $1,000 spending money. ARV: $5,500. Anniversary Contest Second Place: One (1) Monthly Contest Winner will be awarded second place and will receive a 5-night, 6-day trip for two persons to Walt Disney World, Orlando, FL, including hotel, roundtrip airfare, ground transportation to and from airport, Walt Disney World park admission, and $900 spending money. ARV: $3,900. Anniversary Contest Third Place: One (1) Monthly Contest Winner will be awarded third place and receive a 4-night, 5-day trip for two persons to San Diego, California, including hotel, roundtrip airfare, ground transportation to and from airport, admission to Sea World, and $800 spending money. ARV: $3,000.

Airfare will be coach-class airfare from the closest major airport to winner's residence. Hotel accommodations will be a single room, double occupancy. All other travel and travel-related expenses not expressly provided for above are the responsibility of the winner. All awards are non-transferable and not redeemable for cash. Gift Certificates are valid for 12 months from date of issuance unless expiration is otherwise prohibited or restricted by law. Travel must be completed within twelve (12) months of confirmation of award. Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion if the designated prize is unavailable or inappropriate for any reason. Approximate retail value of all prizes: $66,400.

6. TERMS: By entering the contest, Entrants: (i) acknowledge compliance with these Official Rules, including all eligibility requirements and copyright ownership of submitted photographs; (ii) agree to be bound by the winner selections of the judges, which are final and binding in all respects; (iii) agree that Sponsor has sole discretion to resolve any dispute as it sees fit; and (iv) agree that neither you nor your heirs, successors or assigns will assert any claim relating to damages, losses or injuries against Sponsor, or its agents, affiliates, subsidiaries, divisions, attorneys, printers and advertising and promotion agencies. All entry information becomes the property of Sponsor. Entrants retain the copyright to their photographs; however, by entering the contest, Entrants grant Sponsor a perpetual, irrevocable, royalty-free, worldwide license to display any submitted photographs, Entrant name and pet name on Sponsor website, in Sponsor product catalogs, and within Sponsor advertising and promotions without any fee or other form of compensation. Sponsor may make and retain copies of any submitted photograph for contest and archival purposes. If the ownership of any photograph or rights to a submitted photograph is contested in any manner, Sponsor retains the right to disqualify the entry and discontinue use of the photograph. This contest is subject to U.S. federal, state and local laws and regulations. Sponsor, or its agents, affiliates, subsidiaries, divisions, attorneys and advertising and promotion agencies (i) makes no warranty, guaranty or representation of any kind concerning any prize; (ii) disclaims any implied warranty; and (iii) is not in any way responsible or liable for damage, loss or injury resulting from altered, late, lost, damaged, misdirected, mutilated, illegible or incomplete entries, or human, telephone, computer, online, or technical malfunctions, failures or difficulties (including busy lines and disconnections) of any kind, or acceptance and use of a prize or travel in connection with such prize. Winner assumes liability for injuries caused or claimed to be caused by participating in the contest, or by the acceptance, possession or use of any prize.

7. CONDITIONS: No correspondence will be entered into by Sponsor. Any tax due on the prize is the sole responsibility of the winner. Sponsor reserves the right to verify eligibility qualifications of all winners. To be confirmed as a Contest Winner, each selected winner must first complete and return within ten (10) days of receipt from Sponsor (i) an Affidavit of Eligibility and Publicity/Liability Release ("Affidavit") and return them, notarized, and (ii) all taxation forms required by Sponsor. Furthermore, all travel companions must complete and return at the same time a Publicity/Liability Release. Failure to return all fully completed Affidavits and tax forms within ten (10) business days will result in forfeiture of eligibility to be awarded a prize, and Sponsor will select an alternative prize winner. No substitution or transfer of any prize is permitted. All Monthly Winners and Contest Winners hereby consent to the use of his/her name, pet name (if applicable) and submitted photograph for promotional purposes without additional compensation, unless prohibited by law. Persons found tampering with or abusing any aspect of this contest as solely determined by the Sponsor will be disqualified from winning any prize. In the event the contest is compromised by a virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor which corrupts or impairs the administration, security, fairness or proper play of the contest, Sponsor reserves the right in its sole discretion to suspend or terminate the contest and award prizes in a later contest. Should the contest be terminated prior to the stated expiration date, notice will be posted at www.drsfostersmith.com/photocontest. No more than one prize will be awarded for each Monthly Contest Prize and Anniversary Contest Prize. Once submitted, entries cannot be changed or withdrawn from the contest.

9. WINNERS: The names of all winners will be posted online on the DrsFosterSmith.com website.
